1:00 PURCHASE CONTRACT
This website is owned and operated by Dial Design & Print Ltd (DialDP). All purchases made on this website are governed by these terms and conditions. Although these terms and conditions may change from time to time, the terms and conditions governing any given purchase shall be those in effect at the date of purchase order being placed. You are advised to check and ensure you understand these terms and conditions each time you place an order. In order to assist, the date of the last update will be displayed at the bottom of this page.
2:00 DATA PROTECTION ACT 2018
This act protects personal information given to us by individuals and how we must treat that information.
All information will be held securely and never, used for marketing purposes or shared with third parties. We do not process your information in any way and only hold what is required to fulfil your order. We only hold personal information you give us, and never seek to request irrelevant information. Normally we will delete personal data after twelve months of inactivity, however we can delete it immediately after use if you ask us to do so in writing. You also have the right to request copies of all personal details we hold on you at anytime. We never hold, store or process payment card details, these are deleted immediately payment is confirmed.
3:00 AVAILABILITY
As this is primarily a "Print on Demand" website all orders are subject to availability of our suppliers. We will endeavour to complete your order in seven to fourteen days. Popular items and sizes etc. are sometimes held in stock. In the event we cannot fulfil your order, we will notify you and refund any payments made by the same method as those payments were made.
4:00 DELIVERY
Delivery will usually be via third party, such as Royal Mail or DPD. Anticipated delivery times are included in our order completion timescale above and are based on UK delivery. However, due to circumstances beyond our control, thesecan sometimesbe a little longer. Where a delay is known about we will inform you of this.
5:00 WARRANTY AND LIABILITY
Nothing in these terms and conditions will restrict our liability for death or personal injury resulting from our negligence. Neither will any of these terms and conditions restrict your statutory rights.
In addition to that outlined above, we will not be deemed to be in breach of contract or the terms and conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstances beyond our reasonable control. This includes but is not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of any type of crime or war.
Other than as set out above, our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.
6:00 COMPLAINTS AND RETURNS
It is the intentions of Dial Design & Print Ltd (DialDP) to offer the best possible experience with us. However with the best of intentions things can very occasionally fail. On the rare times this happens we will do all we can to put things right. Below is a summary of our policy, these terms and conditions do not affect your statutory rights.
6:01 REDBUBBLE
RedBubble act as an agent on behalf of DialDP. They have their own complaints and returns procedures and policies. For all items purchased via RedBubble you should in the first instance contact them and follow their processes and procedures.
6:02 DIRECT FROM DIAL DESIGN & PRINT LTD (DialDP)
For complaints please either use our contact form, email or write to us at our head office. You will need to tell us as much information as you can about your experience and why you are unhappy. Please submit any supporting evidence you have to hand. A member of our support team will be in touch if further details are required. In all instances we will endeavour to write to you with regards to the outcome of the investigation.
For returns due to quality issues, these will be replaced or refunded at DialDP's discretion. Your original order number must be included, and the item returned within 90 days of purchase, stating the nature of the quantity failure.
For returns of unwanted items - except personalised printed products. These must be returned sealed in their original packaging (excluding postage packaging). Your original order number must be included, and the item returned within 90 days of purchase, stating the reason for return. With regret garments that have been worn cannot be returned for health reasons. Example Corvid-19. Personalised printed products cannot be returned as unwanted due to the non-resaleable nature.
7:00 WHAT WE WILL AND WILL NOT PRINT
It is not the intention of DialDP to either break the law or cause offence or distress. This is particularly with respect to the Equality Act and the Obscene Publications Act.
7:01 WHAT WE WILL PRINT
Essentially DialDP will endeavour to print pretty much whatever you want without prejudice. It must be noted that some slogans that you may ask for could contain foul language. In this event we are happy to print provided the purchaser or wearer accepts full responsibility if any complaint or arrest is made due to the content. We are also happy to print political or protest items provided they do not fall foul of section 2:02 as set out below.
7:02 WHAT WE WILL NOT PRINT
DialDP is fully committed to equality. Therefore we will not print anything that contravenes the nine characteristics of the Equality Act. Nor will we print any obscene material. In general you should not promote;
- Insult or intimidation towards any other section of society.
- Any kind of racial or sexual prejudice.
- Any kind of racial or sexual hatred.
- Any kind of violence or civil unrest.
- Any unlawful or unethical acts whether sexual or not.
- Extreme right or left wing politics or party which actively supports any of the above.
- Any outlawed organisation.
If in doubt please feel free to ask. DialDP reserves the right to make the final decision on whether to print or not.
8:00 COPYRIGHT
All artworks supplied by the client will remain copyright of the client at all times. Where the client does not hold copyright, it is their responsibility to obtain consent from the copyright holder. DialDP will accept artworks from the client on the clear understanding that correct approvals have been sought by the client. Any actions taken due to an alleged breach of copyright by the client, will be the clients liability and DialDP will not at anytime accept any responsibility for any breach of copyright.
9:00 PRICES
All prices are in UK pounds. For sales to the general public, they are inclusive of VAT where applicable and delivery (within the UK). For corporate sales, they are exclusive of VAT and delivery. The prices charged will be as advertised on the on the website at the time you place your purchase order. This is subject only to any inadvertent or technical error for which we will not be liable. If you amend your order, the prices charged will be those applicable at the time that the amended order is confirmed.
10:00 PAYMENT
Below are the general methods for payment accepted. All goods remain the property of Dial Design & Print Ltd until full payment is received.
10:01 GENERAL PUBLIC (www.dialdp.co.uk)
Payment by the general public can be made in person by cash on delivery or credit/debit card. Payments are due immediately the order is delivered. Sales through our online store are payable in advance.
10:01 CORPORATE (www.dialdp.com)
When purchasing through our trade counter you will need to open an account and you must be a registered company at Companies House.
For non-credit account holders you will need to pay on delivery or in advance. This can be by cash or credit/debit card.
For credit account holders, invoices will be sent out on the last Monday of the calendar month. Payment is 30 days of the invoice issue date. Payment is usually by bank transfer but can be by cash or credit/debit card by arrangement. DialDP reserves the right to limit or decline an application for a credit account. DialDP also reserves the right to suspend or terminate a credit account at anytime. Clients will be notified in writing if their account is suspended or terminated. Upon termination of a credit account the full outstanding balance will immediately become due.
